In March 2014, Birmingham City Council introduced 5 Dog Control Orders. The Orders were brought in to tackle irresponsible dog owners who failed to control or clear up after their dogs. Particular concerns involved dogs that were allowed to roam loose on the roads, dog fouling and dogs straying onto school land. There was a full public consultation carried out prior to the Orders being made.

In March 2014, Birmingham City Council introduced 5 Dog Control Orders. The Orders were brought in to tackle irresponsible dog owners who failed to control or clear up after their dogs. Particular concerns involved dogs that were allowed to roam loose on the roads, dog fouling and dogs straying onto school land. There was a full public consultation carried out prior to the Orders being made.  
 
The Orders will cease to be in effect in October 2017, due to changes imposed by the Anti-Social Behaviour Crime and Policing Act 2014; it is proposed to change the Dog Control Orders into Public Space Protection Orders and we are required to carry out a consultation.  
Current Dog Control Orders
 
1. The Fouling of Land by Dogs Order 2014 – it is an offence for a person in charge of a dog to fail to remove faeces forthwith from any land to which the public have access. 
 
2. The Dogs on Leads Order 2014 – it is an offence for a person in charge of a dog to fail to ensure that a dog is kept on a lead at all times on all public roads, adjoining footways and verges.   
 
3. The Dogs Exclusion Order 2014 – it is an offence for a person in charge of a dog to permit the dog to enter into or remain in any of the following areas: 
any clearly demarcated children's play area, and 
School land. 
 
4. The Dogs on Leads by Direction Order 2014 – it is an offence for a person in charge of a dog to fail to put their dog on a lead when directed to do so by an authorised officer on any land to which the public have access and is open to the air.
 
5. The Dogs (specified Maximum) Order 2014 – it is an offence for any person to take more than four dogs onto open land in Birmingham.

What will change?
 
There will be no changes to the current legal requirements contained in the Dog Control Orders; however as part on the consultation process we are proposing to increase the amount of a Fixed Penalty Notices for offences from £80 to £100.  
 
Please note there are exemptions for Assistance Dogs.
