Overview

Birmingham City Council is conducting a consultation on its Conditions of Tenancy for all current and future Council tenants. Our Conditions of Tenancy apply to all tenants and the proposed new version will replace the current version - (current version is viewable at Conditions of Tenancy | Birmingham City Council)

The consultation will run for twelve weeks from 20/12/24 to 16/03/25.

As a landlord, the Council is required to clearly set out our what our tenants can expect from us and how we expect our tenants to manage their tenancies; this ensures that our responsibilities as a landlord and your responsibilities as a tenant are clear and fair.

The Council’s current Conditions of Tenancy have been in place since 2010 and need to be revised; they have not kept pace with changes in law, regulation and generally accepted good practice.

In drafting our proposed new Conditions of Tenancy, we have taken legal advice and have reviewed the conditions internally across the relevant areas relevant to tenants (such as rents, tenancy and estate management, repairs etc) to ensure that the conditions are robust, transparent and fair.

Following this twelve week consultation period, we will consider all the feedback we receive and may modify or amend the proposed changes as a result of that feedback; we will then seek approval from the Council’s Cabinet for the final version of the Conditions of Tenancy. All current tenants will be issued with a notice of variation, outlining actual changes to the Conditions of Tenancy, which both all tenants and the Council will be bound by from the date that the new Conditions of Tenancy come into effect. Why your views matter

Your views are important to us; the Council currently manages a housing stock of in excess of 59,000 properties of different types across the city, and these Conditions of Tenancy, once implemented, will apply to all tenants. It is therefore vital that all tenants are given an opportunity to comment as we want to ensure that our Conditions of Tenancy are fit for purpose, clear and fair, and that our tenants understand the reasons for implementing them and have been involved in the process.

What happens next

The consultation period is now open and will take place between December 2024 and March 2025. Once concluded, the Council will assess the feedback received and see what changes might need to be made to the conditions of tenancy.

Anything that changes will be publicly available, and a communication will be released around what changes have been made and what were not able to be change and why.
